AmCham Moldova a comunicat Ministerului Agriculturii și Industriei Alimentare susținerea de principiu a proiectului de lege privind etichetarea alimentelor și taxele controlului oficial în domeniul agroalimentar, formulând două obiecții.
Prima obiecție vizează propunerea ca, în cazul în care proporția sucului de fructe este egală sau mai mare de 4%, să fie menționată denumirea fructului, iar dacă proporția este mai mică de 4%, să fie utilizată mențiunea „cu aromă de”. AmCham menționează că nu există o reglementare europeană care să stabilească pragul de 4% drept criteriu de delimitare între suc și aromă. Utilizarea denumirii fructului nu depinde de concentrația acestuia, ci de prezența sa efectivă în băutură, iar o concentrație mai mică de 4% nu transformă sucul sau băutura care conține suc în aromă. În consecință, AmCham propune excluderea acestei prevederi.
A doua obiecție se referă la etichetarea produselor care conțin cafeină. AmCham propune ca, pentru un conținut mai mare de 150 mg/l, să fie indicată mențiunea privind conținutul ridicat de cafeină și faptul că produsul nu este recomandat copiilor sau femeilor însărcinate ori care alăptează. Pentru un conținut mai mare de 1 mg/l se propune mențiunea „conține cafeină”, iar pentru băuturile care conțin de regulă cafeină, dar au o concentrație mai mică de 1 mg/l – mențiunea „fără cafeină”. Regulamentul (UE) nr. 1169/2011 nu prevede pragul de 30 mg/l propus în proiect, ci doar pragul de 150 mg/l pentru avertizarea privind conținutul ridicat de cafeină.

AmCham Moldova informed the Ministry of Agriculture and Food Industry of its general support for the draft law concerning food labelling and official control fees in the agri-food sector, while raising two objections.
The first objection concerns the proposal to indicate the name of the fruit when fruit juice accounts for at least 4% of the beverage and to use the statement “flavoured with” when the proportion is below 4%. AmCham notes that no European regulation establishes a 4% threshold for distinguishing between juice and flavouring. The use of the fruit’s name does not depend on its concentration but on its actual presence in the beverage, while a concentration below 4% does not turn the juice or a juice-containing beverage into flavouring. AmCham therefore proposes removing this provision.
The second objection concerns the labelling of products containing caffeine. AmCham proposes that products containing more than 150 mg/l carry a high-caffeine statement and a warning that they are not recommended for children or women who are pregnant or breastfeeding. Products containing more than 1 mg/l should carry the statement “contains caffeine,” while beverages that normally contain caffeine but have a concentration below 1 mg/l should be labelled “caffeine-free.” Regulation (EU) No. 1169/2011 does not provide for the 30 mg/l threshold proposed in the draft, but only for a 150 mg/l threshold for the high-caffeine warning.
