Improved regulations on the road traffic safety

On March 2, 2023, the Parliament adopted in the final reading the draft law amending several normative acts (Administrative Offences Code, Road Traffic Safety Law). The draft law can be accessed at the following LINK.

AmCham has actively promoted the exclusion from the draft law of the new bans on:

- the registration of vehicles in case of the existence of non-enforced administrative sanctions applied by the court's decision on the infringement committed with the vehicle whose registration is requested;

- carrying out periodic technical inspections of vehicles in case of the existence of non-enforced administrative sanctions applied by the court's decision on the infringement committed with the vehicle whose periodic technical inspection is requested to be conducted.

Suppose the regulations had been adopted in the original version. In that case, if the employees of the economic agents had committed an infringement with the vehicle owned by the legal entity, the latter could not have been subjected to the periodic technical inspection if the offenders (employees) would not voluntarily execute the administrative sanctions (or if the legal entities did not pay the fines itself).

AmCham considered that the draft proposed mechanism infringes the right of legal entities to operate the vehicles owned and violates the principle of the personal character of administrative liability.
