This Legal Flash brings you latest news on adoption of the new Law on Mediation, amendments to the Law on the National Bank, new Law on Government Agent, approval by the Stock Exchange Council of the new Regulation and on transposing of certain normative acts of EU related to plastic materials and ceramic articles coming into contact with food.
The law intervenes with amendments related to complying with the principle of confidentiality. Thus, law changes the approach to the principle of confidentiality in such a way that maintaining the confidentiality becomes an obligation of the mediator. The law sets additional criteria for accession to the profession of a mediator. The law also amends certain general rules for the conduct of the mediation process.
Another innovative element refers to the method of selecting the mediator. Thus, the parties will have the possibility to appoint one or more mediators by mutual agreement or request that the mediation organization appoints a mediator under its own internal rules.
The Law No 147 amends and supplements, inter alia, Law of the Republic of Moldova No 548 dated 21 July 1995 on the National Bank of Moldova. Amendments refer to the following: governing bodies of the National Bank, composition, mode of appointment and removal of their members; attributions of governing bodies; the audit committee and internal audit; guarantees in exercising the attributions.
A number of new regulations refer to the payment system and are concerned with supervision of the payment system in Moldova; regulation and supervision of the activity of providing payment services and issuing electronic money; and provision of clearing and payment services. Amendments mention the right of the National Bank to conclude agreements of cooperation and exchange of information with authorities entrusted with regulation and supervision of banking and financial sector in other countries.
