On June 8, the Government approved amendments to the governmental regulation on medical public procurement, ensuring a balanced reduction of delay penalties imposed on suppliers of drugs and medical devices. Under the modified regulation, for the first 30 days of delay, the daily penalty has been reduced from 1% to 0,1% out of the goods’ value. AmCham and partner organizations have previously brought the topic to the attention of the Economic Council under the Prime minister and the competent ministries, having had more than three public-private meetings and six written communications on the regulation’s text. 

In this, AmCham has advocated that a balanced value of contractual penalties can boost the number of participants to public procurement proceedings, lead to better risk assessment and lower pricing, benefitting both public and private sectors.
